Terms of Use

Alzor · Last updated [EFFECTIVE DATE]

These Terms of Use are the end user license agreement (EULA) between you and [LEGAL ENTITY NAME], a company organized under the laws of [STATE], with its address at [ADDRESS] ("Alzor", "we", "us"). By creating an account or using the app, you accept everything below. If you do not agree, do not use the app.

1. What Alzor is

Alzor is a training app with game elements. It generates exercise routines using artificial intelligence, logs your workouts and meals, and adds rank progression, streaks, quests, a companion, duels, guilds, leaderboards and companion battles.

2. Your account

3. Subscription and payments

4. Gems and virtual economy

Gems cannot be bought with real money. They are earned only by training: completing quests, beating records and taking part in the game's mechanics.

5. Health and safety

Alzor is not a medical service and does not replace advice from a healthcare professional. Routines are generated by an artificial intelligence model and may contain mistakes, including loads or exercises that are unsuitable for your physical condition.

6. AI-generated content

Routines, their descriptions and their notes are generated by an OpenAI language model from your profile data. It may produce inaccurate, repetitive or inappropriate content. We do not guarantee any physical result or the accuracy of the generated content. If you find a routine that is dangerous or inappropriate, write to soporte@alzor.app.

Calorie and macro estimates, whether they come from the AI estimate, from Open Food Facts or from our food database, are approximations and are not nutritional or medical advice.

Exactly which data is sent to OpenAI is detailed in the Privacy Policy.

7. User conduct and content

Some of the text you write is visible to other people: your display name in leaderboards and searches, and the name and description of the guilds and challenges you create. By posting it you accept a zero-tolerance policy toward abusive content.

The following is not allowed:

You can report abusive content or behavior by writing to soporte@alzor.app. We review every report and may remove content, suspend or close accounts without prior notice when these terms are breached.

You keep ownership of the content you create. You grant us a worldwide, non-exclusive, royalty-free license to host and display it inside the app for the sole purpose of operating the service.

8. Intellectual property

The app, its code, its design, its artwork, its trademarks and its texts belong to us and are protected by law. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and use the app on devices you own or control, solely for your personal, non-commercial use. No other rights are granted.

9. Availability and changes to the service

We work to keep the service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features. If we materially discontinue a paid feature during a period you already paid for, you may request a proportional refund through the relevant store.

10. Termination

You may stop using the app and delete your account whenever you like. We may suspend or close your account if you breach these terms or if your use puts the service or other people at risk. Termination does not entitle you to a refund of periods already paid for, unless the law provides otherwise.

11. Limitation of liability

The app is provided "as is" and "as available", without warranties of any kind beyond those the law imposes mandatorily. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages, nor for lost profits or lost data. Our total cumulative liability to you is limited to the amount you paid us for the subscription in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes or limits our liability for willful misconduct, gross negligence, personal injury caused by our negligence, or any other liability that cannot lawfully be excluded. If you are a consumer, you keep in full the rights granted to you by the consumer protection rules of your country.

12. Apple and Google

These terms are an agreement between you and [LEGAL ENTITY NAME], not with Apple or Google. Neither company is responsible for the app or its content, and neither provides support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. By using the app you represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of restricted parties.

13. Governing law

If you live in the United States, these terms and any dispute between you and Alzor are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules, and the arbitration agreement in section 14 is governed by the Federal Arbitration Act. If you live outside the United States, these terms are governed by the laws of the State of [STATE], but you keep the protection of the mandatory consumer laws of your country of residence, and you may bring a claim in the courts of that country.

Any claim that is not subject to arbitration under section 14 will be brought only in the state or federal courts located in [STATE], and you and Alzor consent to their jurisdiction, except where the law of your country gives you the right to sue at home.

14. Dispute resolution: binding individual arbitration and class action waiver

Please read this section carefully. It applies if you live in the United States. It requires you and Alzor to resolve most disputes through binding individual arbitration instead of in court, and it waives your right to a jury trial and to take part in a class action. You can opt out within 30 days, as explained below.

Informal resolution first

Before starting an arbitration or a small claims case, you and Alzor agree to try to resolve the dispute informally for at least 60 days. To start, send a written notice to soporte@alzor.app (or by mail to [LEGAL ENTITY NAME], [ADDRESS]) with your name, the email on your account, a description of the dispute and the relief you want. We will send any notice to the email on your account.

Agreement to arbitrate

Any dispute, claim or controversy arising out of or relating to these terms, the app or the service, including disputes about the scope or enforceability of this agreement to arbitrate, will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time. A single arbitrator will decide the dispute. The arbitration may take place by video, phone or written submissions, or in person in the county where you live. Payment of filing and arbitrator fees will follow the AAA Consumer Arbitration Rules, and for claims under $10,000 Alzor will pay the fees you would otherwise owe, unless the arbitrator finds your claim frivolous. The arbitrator may award the same individual relief a court could, and the award may be entered in any court with jurisdiction.

Exceptions

Class action and jury trial waiver

You and Alzor may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may award relief only in favor of the individual party seeking it and only to the extent needed for that party's individual claim. You and Alzor waive any right to a jury trial. If this class action waiver is found unenforceable for a particular claim, that claim (and only that claim) will be severed and decided in court, after the individual arbitration of the remaining claims.

Mass filings

If 25 or more similar demands for arbitration are filed against Alzor by or with the help of the same law firm or organization, they will be administered in batches of up to 50 under the AAA's mass arbitration procedures, and the statute of limitations is tolled for the demands waiting in later batches.

30-day right to opt out

You can opt out of this arbitration agreement by sending an email to soporte@alzor.app with the subject "Arbitration opt-out", from the email on your account, stating your name and that you opt out of arbitration, within 30 days after you first accept these terms (for existing users, within 30 days after [EFFECTIVE DATE]). Opting out does not affect any other part of these terms or your access to the app. If you opt out, section 13 still applies.

Changes to this section

If we change this section in the future, the change will not apply to a dispute we already had notice of, and you may reject the change by writing to us within 30 days of it taking effect, in which case the previous version of this section continues to apply to you.

15. General

If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These terms, together with the Privacy Policy and the Consumer Health Data Privacy Policy, are the entire agreement between you and Alzor about the app.

16. Changes to these terms

We may update these terms. If the change is material, we will notify you inside the app before it takes effect. Continuing to use the app after that date means you accept the updated version.
